A: YOUR HOUSE MUST BE ABLE TO BEAR THE LOAD OF THE NEW CONSTRUCTION. IF NOT, YES YOU DO HAVE TO UPDATE THE LOAD CAPACITY TO BE ABLE TO SUSTAIN THE NEW CONSTRUCTION. THIS DOES NOT APPLY TO EVERYTHING HOWEVER, THE UPDATES MUST BE DOCUMENTED IN YOUR CONSTRUCTION DRAWINGS TO SHOW THAT THE HOUSE IS BROUGHT UP TO CODE AND WILL ACCOMMODATE BOTH THE NEW AND EXISTING HOUSE. |

Q: I am trying to figure out how the City of Atlanta determines if the addition will require me to bring the entire house up to code? This could be an issue b/c bringing this old house entirely up to today's code will be difficult. |

Q: I don't know the exact amount, but depending on what percentage of the house you increase, you may be required to bring the entire house up to code versus being grandfathered in. Can you ask what percentage this is? |

A: NO! THEY DO NOT RECOGNIZE THESE TYPES OF INSPECTIONS. VERY RARELY THOUGH, IN EXTREME CASES, THE CITY WILL REQUIRE A PRIVATE ENGINEERED INSPECTOR BUT ONLY AT THE DISCRETION OF THE CHIEF BUILDING INSPECTOR OR BUILDING AUTHORITY. |

Q: If I have an accessory structure that is encroaching a minimum yard setback, can I add onto it without penalty of applying for a variance? |

A: IT DEPENDS ON THE MUNICIPALITY. SOME WILL ALLOW YOU TO ADD ON AS LONG AS THE EXISTING STRUCTURE IS NOT REBUILT (EXCEPTION: A FIRE OR NATURAL DISASTER). OTHERS WILL HAVE LIMITATIONS ON THE SIZE OF THE ACCESSORY STRUCTURE AND THEN SOME WILL MAKE YOU APPLY FOR A VARIANCE TO ALLOW THE EXISTING NON-CONFORMING STRUCTURE AS WELL ANY OTHER RENOVATION, ADDITIONS OR EXPANSIONS OF THE USE OF IT (I.E. ADDING A ONE ROOM LOFT ABOVE) |

A: AGAIN, IT DEPENDS ON THE MUNICIPALITY. THE CITY OF ATLANTA GIVES YOU 60 DAYS, COBB CO GIVES YOU 30 –60 DAYS. IF YOUR PERMIT EXPIRES THEN YOU MAY BE REQUIRED TO REPERMIT THE PROJECT WHICH MOST OF THE TIME INCLUDES A NEW FEE TO REINSTATE THE PERMIT, A NEW INSPECTION, ETC. Note:*****The destruction of trees is NOT ALLOWED during demolition construction. |
